The European Union’s next generation privacy law, the General Data Protection Regulation (GDPR), is being implemented now. The GDPR will directly or indirectly affect life sciences companies and other companies around the world that do business in the EU or otherwise process personal data that comes from the EU. Full compliance with the GDPR is required by May 25, 2018 and EU data protection authorities are continuing to release new guidance on about the GDPR and its many new requirements. The GDPR will have an impact on a wide range of activities for affected companies, including notices to consumers, contracts with business partners, recordkeeping, privacy assessments, security, and data breach response, among many others. Penalties for non-compliance can be as much as 20 million Euros (approximately $23.5 million) or 4% of an organization’s global turnover, whichever is greater.
