SUMMARY:The Law and Logics of Attribution: Constructing the Identity and Responsibility of States and Firms
DESCRIPTION:When private companies perform governmental functions and governments own companies\, which acts should be attributed to the state? Which should be attributed to the corporation? And whose religious beliefs\, speech rights\, and moral standing can those entities claim? \nIn international law\, scholars and practitioners struggle to attribute rights and responsibilities between state and private entities in areas as diverse as military contracting\, environmental accountability\, human rights\, international investment\, and cyber espionage and warfare. In the corporate governance realm\, attributing responsibility to entities is increasingly challenging in the context of globally dispersed corporate families with intricate parent-subsidiary structures; identity attribution has also produced headlining debates. \nWhile attribution questions fuel important conversations in both corporate and international law\, the two literatures are not often in conversation. Questions of attribution in both domains nevertheless are becoming more complex and urgent\, and the fields increasingly intersect: In some areas of law\, attribution doctrines must determine the dividing line between states and firms. Doctrines of attribution construct the public domain\, and thereby also the private. Attribution questions in both domains reinvigorate classic inquiries about the nature of a corporation\, the relationship between private entities and the state\, and the proper function of the law in mediating between the two. \nThis conference will draw together corporate and international legal scholars\, as well as thinkers outside the law\, in order to cross-pollinate these two fields and the questions at their intersection\, and to unearth promising theoretical tools. It will consider theoretical and doctrinal approaches to attribution\, potential consequences of these approaches\, and whether they may reconcile the ambiguities and deficiencies that drive current debates. The project aims to offer a new point of entry to enduring theoretical and doctrinal questions about the nature of corporations\, of states\, and of the relationship between them. It is particularly relevant at a time where corporations are “jurisdictionally ambiguous and spatially diffuse\,” states are deferential\, dependent or outflanked\, and multilateralism is at an ebb. \nThe virtual forum is co-sponsored by the American Society of International Law; the Society’s Interest Group on International Legal Theory;and the Dean Rusk International Law Center at the University of Georgia School of Law.

SUMMARY:2020 U.S. Law Updates to Know for Japanese and Other Foreign Firms
DESCRIPTION:Join Baker Donelson and Kitahama Partners Joint Seminar co-sponsored by JETRO\, JASG and JCCG \nBaker Donelson will provide updates on several key U.S. laws that Japanese businesses should know about to help reach their goals and objectives for 2020. \nThey will cover: \n\nCFIUS Regulations\nThe Committee on Foreign Investment in the United States (CFIUS) is an inter-agency committee chaired by the Treasury Department with the authority to review\, modify and potentially reject certain types of foreign investment that could adversely affect U.S. national security. CFIUS’s new regulation can have enormous impact on transactions in U.S. because even a minority investment in a U.S. company may be subject to the CFIUS review. To avoid unexpected delay or failure of transaction\, you must know this new regulation.\nEssentials of the California Consumer Privacy Act (CCPA)\nThe CCPA is an expansive privacy law which provides consumers with more rights and control over the personal information that businesses collect about them. The law went into effect on January 1\, 2020\, but continues to evolve in advance of the Attorney General beginning enforcement on July 1\, 2020. It’s a good time to double-check your company’s data activities relating to California consumers and it’s not too late to address the CCPA compliance obligations.\nThe current landscape of Legalized Marijuana\nThere are a number of inconsistencies between US Federal and State laws that make it difficult to determine what is legal. 33 states plus the District of Columbia have legalized marijuana for medical purposes\, and 11 states have legalized marijuana for recreational use. Are you prepared for dealing with marijuana which appears in relation to your business and workplace?\n\nAlso joining are attorneys from Kitahama Partners from Japan. They will present “How to Handle Legal Matters in the US from Japanese Perspective\,” and also can provide insights for U.S. companies doing business in Japan. \nModerator and Speakers: \n\nBob Johnson\, Baker Donelson\, Shareholder\nJohn M. SUMMARY:The Future of Space Governance
DESCRIPTION:This conference takes a stakeholder approach to emerging questions of outer space governance. It seeks to understand the perspective and concerns of classic space powers\, new entrants\, non-space faring nations\, and international organizations like the Committee on the Peaceful Uses of Outer Space\, as well as civilian space agencies\, national militaries\, and commercial actors. It asks for views on the sufficiency of existing law and governance structures and probes the legal needs of new and existing stakeholders. It will explore the agendas of the growing collection of actors\, and attempt to find new prospects for governance.\nThe Dean Rusk International Law Center and the Georgia Journal of International and Comparative Law at the University of Georgia School of Law will host a daylong conference to explore these developments on Monday\, October 28\, 2019\, at the law school’s Athens campus. The conference will feature a keynote speech by Professor Emerita Joanne Irene Gabrynowicz\, University of Mississippi School of Law. Experts from academia and the practice will present on panels. Presentations will be published in the Georgia Journal of International and Comparative Law. \nThe nearest parking deck is the North Campus Deck on South Jackson Street; the maximum daily fee is $10. From the North Deck\, cross Jackson Street\, and onto campus; Dean Rusk Hall is located at the southwestern corner of the quad\, between the Main Library building\, and Hirsch Hall. The conference will take place in the Larry Walker Room\, on the 4th floor\, accessible by elevator and stairs.

SUMMARY:ACIR Hosts Joe Bankoff: "Fake News in the World Today."
DESCRIPTION:During the Cold War we were exposed to what was then called “Disinformation.” It was a tool often used by the Soviet Union to seed the political environment abroad with credible but misleading and often false information with a deliberate attempt to deceive. In some ways\, today what we call “Fake News” is similar in some ways and perhaps more pernicious in others. Come and engage in a dialogue with Joe Bankoff on “Fake News” in the World Today.” \nJoe Bankoff was appointed chair of The Sam Nunn School of International Affairs in spring 2012 following six years as president & CEO of The Woodruff Arts Center and 32 years as a senior partner at the Atlanta-based law firm of King & Spalding. \nMr. Bankoff’s expertise ranges across law and policy\, economic development\, government legislation\, fiscal planning\, and global issues. In 1992\, he took a sabbatical from his law firm to accept an appointment as a visiting scholar at the Max Planck Institute for Intellectual Property & Competition Law\, Munich\, Germany.  There he became engaged in the analysis of multi-jurisdictional copyright claims arising from satellite television in Europe.  He later represented German Television (ZDF) in a related dispute with Turner Broadcasting.  He also served as counsel to Atlanta’s Olympic Organizing Committee negotiating the television rights agreements for Europe (EBU)\, Canada\, Australia\, Latin and South America\, and the United States.

SUMMARY:The International Criminal Court and the Community of Nations
DESCRIPTION:Resolved to guarantee lasting respect for and\nthe enforcement of international justice…\n– Preamble\, Rome Statute \nAcross the globe\, resurgent nationalisms place stress on institutions designed to promote human and collective security through international cooperation. Critiques – even\, at times\, outright denunciations – compel such institutions to re-examine\, in a process that poses challenges yet also portends opportunities for renewal. The dynamic surely affects the International Criminal Court. In the last several months alone\, states as varied as Burundi\, the Philippines\, and the United States have levied harsh criticism against this twenty-year-old justice institution\, established in recognition that “children\, women and men have been victims of unimaginable atrocities” that “threaten the peace\, security and well-being of the world.” \nIn the same time frame\, the ICC Prosecutor welcomed a multistate referral of alleged crimes in Venezuela and launched a preliminary examination into alleged forced deportation in Myanmar\, and the Court as a whole continued complementary efforts to strengthen national and regional prevention and accountability. It did so within legal\, geopolitical\, and budgetary constraints imposed by a trio of stakeholder communities. \nThe Dean Rusk International Law Center and the Georgia Journal of International and Comparative Law at the University of Georgia School of Law will host a daylong conference to explore these developments on Friday\, March 8\, 2019\, at the law school’s Athens campus. The conference will feature a video message from International Criminal Court Prosecutor Fatou Bensouda. \nExperts from academia and the practice will cast a critical eye on “The International Criminal Court and the Community of Nations”; that is\, on the place of the ICC vis-à-vis communities of states parties\, nonparty states\, and nonstate stakeholders\, as well as inherited communities. Presentations will be published in the Georgia Journal of International and Comparative Law. \nThis event is free and open to the public\, but registration is required. CLE is available for a fee. \nFor the full schedule\, please visit the conference website: https://www.law.uga.edu/gjicl2019

SUMMARY:Great Decisions Foreign Policy Lecture Series: The Rise of Populism in Europe
DESCRIPTION:Speaker: Eleanor Morris\, Ph.D.\, Agnes Scott College \nMass migration\, and the problems associated with it\, have directly abetted the rise of populist parties in Europe. Opposition to immigration was the prime driver of support for Brexit\, it brought a far-right party to the German Bundestag for the first time since the 1950s\, and propelled Marine Le Pen to win a third of the vote in the French presidential election. In addition to calling for stronger borders\, however\, these parties are invariably illiberal\, anti-American\, anti-NATO and pro-Kremlin\, making their rise a matter of serious concern for the national security interests of the United States.

SUMMARY:ACIR Presents Ms. Peri Lynne Johnson\, IAEA Legal Advisor\, on Nuclear Safeguards and Nuclear Security
DESCRIPTION:  \nACIR is honored to host Ms. Peri Lynne Johnson\, Legal Advisor and Director of the IAEA Office of Legal Affairs\, who will speak on the topic\, “Nuclear Safeguards and Nuclear Security: Keeping the Genie in the Bottle.” \n  \nHonored guests are to include: \n\nFrank Ginn\, Georgia State Senator for the 47th District\nDon Parsons\, Georgia State Representative for the 44th District\nLauren McDonald\, Chair\, Georgia Public Service Commission\n\nHeadquartered in Vienna\, Austria and established in 1957\, the International Atomic Energy Agency (IAEA) seeks to promote the peaceful use of nuclear energy\, and to inhibit its use for any military purpose\, including nuclear weapons. Though established independently of the United Nations through its own international treaty\, the IAEA reports to both the General Assembly and the Security Council. \nThe IAEA is described as having three main missions: promoting the peaceful uses of nuclear energy by its member states\, implementing safeguards to verify that nuclear energy is not used for military purposes\, and promoting high standards for nuclear safety. \nThe Chernobyl disaster was a major wake-up call for the international community. With the end of the Cold War\, the break-up of the Soviet Union\, and the breakdown in nuclear safeguards\, the disposition of fissile materials added yet another dimension to concerns about nuclear safety and security\, as has the Fukushima nuclear disaster and nuclear developments in Iran and North Korea. Also of keen concern have been attempts by terrorist organizations to acquire nuclear weapons. Come listen to Peri Lynne Johnson\, IAEA Legal Advisor\, address the complexities IAEA confronts and its major concerns as it attempts to ensure and enhance nuclear safety and security. \nMs. Johnson joined the Office of Legal Affairs of the IAEA in January 2011. Previously\, Ms. Johnson served as the Director of the Legal Support Office\, Bureau of Management\, of the United Nations Development Programme (UNDP). In this capacity\, Ms. Johnson provided legal advice to the UNDP Administrator\, Associate Administrator\, Senior Managers at headquarters and Resident Representatives in field offices around the globe\, as well as to the UNDP-Affiliated Funds of the Capital Development Fund (UNCDF)\, the UN Development Fund for Women (UNIFEM now UN Women) and the UN Volunteers Programme (UNV). \nMs. Johnson earned her B.A. in French Literature (with a focus in Government and International Relations)\, with distinction in all subjects\, from Cornell University in Ithaca\, New York\, USA in 1988\, and her Juris Doctor from Harvard Law School in Cambridge\, Massachusetts\, USA\, in 1991.
