SUMMARY:The Law and Logics of Attribution: Constructing the Identity and Responsibility of States and Firms
DESCRIPTION:When private companies perform governmental functions and governments own companies\, which acts should be attributed to the state? Which should be attributed to the corporation? And whose religious beliefs\, speech rights\, and moral standing can those entities claim? \nIn international law\, scholars and practitioners struggle to attribute rights and responsibilities between state and private entities in areas as diverse as military contracting\, environmental accountability\, human rights\, international investment\, and cyber espionage and warfare. In the corporate governance realm\, attributing responsibility to entities is increasingly challenging in the context of globally dispersed corporate families with intricate parent-subsidiary structures; identity attribution has also produced headlining debates. \nWhile attribution questions fuel important conversations in both corporate and international law\, the two literatures are not often in conversation. Questions of attribution in both domains nevertheless are becoming more complex and urgent\, and the fields increasingly intersect: In some areas of law\, attribution doctrines must determine the dividing line between states and firms. Doctrines of attribution construct the public domain\, and thereby also the private. Attribution questions in both domains reinvigorate classic inquiries about the nature of a corporation\, the relationship between private entities and the state\, and the proper function of the law in mediating between the two. \nThis conference will draw together corporate and international legal scholars\, as well as thinkers outside the law\, in order to cross-pollinate these two fields and the questions at their intersection\, and to unearth promising theoretical tools. It will consider theoretical and doctrinal approaches to attribution\, potential consequences of these approaches\, and whether they may reconcile the ambiguities and deficiencies that drive current debates. The project aims to offer a new point of entry to enduring theoretical and doctrinal questions about the nature of corporations\, of states\, and of the relationship between them. It is particularly relevant at a time where corporations are “jurisdictionally ambiguous and spatially diffuse\,” states are deferential\, dependent or outflanked\, and multilateralism is at an ebb. \nThe virtual forum is co-sponsored by the American Society of International Law; the Society’s Interest Group on International Legal Theory;and the Dean Rusk International Law Center at the University of Georgia School of Law.

From 2001-04\, ABBA worked as a Program Manager at Afrique Challenge office for continuous training\, then as Manager General of Capermar\, both subsidiaries in Morocco of COGEFI Afrique Group. She was Head of Pedagogical Department at ESCA Ecole de Management Casablanca from 2004-06. \nABBA has taught Communication and Management classes since 1999. Her areas of expertise are Business Communication\, Problem Solving and Complexity Management. \nIn 2017\, jointly with co-author Z. MAAROUFI\, she was awarded the Prize of Best Case Study in the TEMPUS PORFIRE Project\, a multi-country Joint Project funded by the European Union. He will discuss how China is struggling to leave behind its “Factory to the World” growth model\, and include its hundreds of millions of left-behind migrant workers into a more innovative\, consumption-driven economy and why that means China may not become the superpower the world expects. He will also discuss how COVID-19 has exacerbated the already huge social disparities in China further complicating its ongoing economic transition and putting it at risk of falling into the middle-income trap. He will discuss how global supply chain diversification is affecting China and the implications of a Trump administration turning its back on engagement while a Xi Jinping-led China is determined to pursue a “wolf warrior” assertive approach to the world. \nDexter Roberts is an award-winning writer and speaker on China now serving as a Nonresident Senior Fellow at the Atlantic Council and a Fellow at the University of Montana’s Mansfield Center. Previously he was the China bureau chief and Asia News Editor at Bloomberg Businessweek\, based in Beijing for more than two decades. Roberts’ first book\, The Myth of Chinese Capitalism: The Worker\, the Factory\, and the Future of the World\, was published by St. Martin’s Press in March 2020. He has since completed numerous development\, medical equipment and technology\, management consulting services\, and financing transactions in Latin America\, West Africa\, and Asia\, and is now regarded as a leading authority in the U.S.\, Healthcare development transactions\, trade\, and financing for emerging markets economies. Mr. Williams and the Princeton Team is currently involved in the development of a “State of the Art” Cancer Center\, in a region outside of Sao Paulo\, Brazil\, integrating Proton Therapy Technology\, a leading clinical technology for the treatment of Cancer. In addition\, Princeton is working on several Hospital Development and Expansion Projects within South and Central America. Mr. Williams’s development achievements in Africa and other key emerging markets have led Princeton to receive a special award from the U.S. Department of Commerce\, prestigious awards including International Business of the Year\, and the Globe Award. Mr. Williams and the Princeton Team have worked with a number of leading global hospital systems\, and healthcare firms. At the current time\, Princeton is also currently managing several hospital and healthcare development projects within South America. \nMr. Williams has served as Vice-Chair and currently serves on the United States Department of Commerce’s Industry Sector/Advisory Council on international trade for Small/Medium-Sized Firms\, the top governmental advisory group on small/medium-sized businesses. Mr. Williams is currently a Board Director for the World Trade Center of Atlanta and Board Member of the Corporations Board for Northeastern University.
